If you were recently arrested or charged with a crime, the first thing you should do is invoke your right to silence. You do not want to say anything that can later be used against you at trial. Then you should invoke your right to an attorney. Many people believe that if they tell the police the right thing, they will let you go. If the police have enough evidence to hold you, they're interviewing you to see if they can trick you into giving them evidence they need to criminally prosecute you.
To invoke both your right to an attorney and your right to silence, you will need to do so clearly and unequivocally. You need to say, "I am invoking my right to silence and I am invoking my right to an attorney." If you do not make these statements clearly, the police will not honor your wishes. They will continue to interrogate you and try to use anything you say against you.

If you are stopped and suspected of driving under the influence, the first thing you should do is remain respectful with the police officer stopping you. Do not give the officer any ammunition or motivation to continue their investigation. Second, if you are asked to perform roadside maneuvers, you should politely decline to do so. Roadside maneuvers are completely optional. The police cannot and will not arrest you based on your decision to decline doing field sobriety tests. Also, remember not to say anything that could be used in court. This includes telling an officer you had anything to drink or any other intoxicants.
